Unemployed? Want to boost your career? Getting to know better the Data Protection Officer role

Over 80 countries, including nearly every country in Europe and many in Latin America and the Caribbean, Asia, and Africa, have now adopted comprehensive data protection laws.

Some other countries are debating the draft of a near future data privacy regulation, as India, for instance.

The data privacy regulation in the U.S. in most parts is done by Federal Agencies, such as the FTC or even by sectorial data privacy regulations, such as the HIPPA, FCRA, FACT and FERPA among others.

Besides the data privacy regulations by some federal agencies and some sectorial laws on this matter, nowadays there are also States laws also regulating the use of personal data, as the CCPA – California Consumer Privacy Act, not mentioning the increasing number of States presenting data privacy bills, as the States of Washington and Virginia.

On the top of that, we also need to be aware that there are some international laws that might be applicable to companies overseas, as the European GDPR – General Data Protection Regulation and the Brazilian LGPD, regulating the use of personal data of any person located in their jurisdiction.

But, someone may say that this huge number of regulations is lawyers’ concerns, but the fact is that the solution to comply with all theses data privacy rules is far from being only a legal matter.

Companies are basically the ones who have to comply with these various regulations; and indistinctly the solution to comply with almost all theses rules is by adapting and monitoring the companies procedures in using the personal data, by implementing and using data privacy management software and by training personal.

Therefore, the professional responsible for helping the company to comply with the data privacy rules needs, not only know the data protection laws, but also know how to identify, adapt and monitor the use of the personal data by the company.

A Data Protection Officer or Data Privacy Officer is this professional.

This professional needs to be trained on some methodologies and programs that will help him/her to get the right skills and knowledge to achieve their goals and fulfill their duties.

The book Data Protection and Privacy Management System [1], written by John Kyriazoglou, presents a methodology to implement and manage a program to make companies comply with data privacy laws.

This program is an example of what actions you may take to implement a set of measure to comply with most of data protection legal and technical requirements.

Of course, you may apply these protocols in your organization only after analyzing if they are aligned with the company’s objectives, needs and requirements.

The program goes from making a detailed assessment to establishing data privacy policies applicable to the employees, service providers and even establishing how the company will process the personal data, to establishing new procedures to regulate the use of personal data by the company and how the companies will handle data privacy infringements and data breach.

A Global Data Protection Officer (DPO) or Chief Privacy Officer is an enterprise compliance and security leadership role responsible for overseeing a company’s data protection strategy and its implementation to ensure compliance with data privacy regulations.

A DPO needs to have specialized knowledge of laws, industry standards, information security, and data protection practices. However, this does not mean that he/she must be a lawyer or IT graduate or Compliance professional; he/she is a mix of all roles.

These professionals must have an understanding of the inner workings IT infrastructure, information management systems, and business processes that handle personal data. Excellent management and communication skills are also a necessity for dealing with internal staff, including senior management.

Some training programs may be able to help one in getting this kind of knowledge and become a Global Data Privacy Officer.

GetGlobal International for instance is an international company specialized in data privacy and addresses all topics mentioned above in its face-to-face and online training program called “Data Privacy Boot camp”.

GetGlobal International’s “Data Privacy Boot Camp” [2] is a master-course that trains professionals on how to deal with international data privacy regulations and information security.

The participants start by taking classes with international instructors on all aspects of the European General Data Protection Regulation (GDPR) through the “Foundation GDPR” program learning the concepts of data privacy and all the definitions brought by the GDPR.

In the other hand, during the second program, called “Practitioner”, you will learn how to prepare, organize, implement, manage and improve a data privacy program in your organization through methodologies and practical cases, making you capable of developing a Data Privacy Management Program.

During a third program, the participants also take classes on the CCPA (California Consumer Privacy Act), Brazilian LGPD (Brazilian General Data Protection Law) and Cyber Security with renowned professionals.

You will also learn from an international DPO about the Data Protection Officer’s role and learn about the use of Personal Data Management software.

Moreover, in addition to getting a Global DPOs certificate from GetGlobal International and becoming able to build a data privacy management program under any international regulation, participants will be eligible to take the EXIN DPO certification tests, since GetGlobal is an EXIN training provider.

“EXIN is a leading independent exam and certification institute, having certified millions of professionals in the digital domain. Exin has over 1000 accredited partner in more than 165 countries worldwide”. [3]
